The terms "we", "us" and "our" refer to Lauris Mīlbrets. Lauris Mīlbrets operates the milbrets.com online store and website, including all related information, content, features, tools, products and services (the "Services").
The milbrets.com online store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced in these Terms, describe your rights and responsibilities when using the Services.
Please read these Terms of Service carefully before using the website or purchasing a product.
By accessing, browsing or using the Services, or by purchasing a product through milbrets.com, you agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree with these Terms of Service or our Privacy Policy, please do not use or access the Services.
Nothing in these Terms of Service limits or excludes any mandatory rights you may have under applicable consumer protection laws.
SECTION 1 – ACCESS AND ACCOUNT
By using the Services, you confirm that you are legally capable of entering into a binding contract under the laws applicable to you.
If you create a customer account or provide information when placing an order, you agree to provide information that is accurate, complete and current.
You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account.
You must not use another person's account without their authorization.
We reserve the right to suspend or terminate an account where we reasonably believe that the account is being used unlawfully, fraudulently or in violation of these Terms.
SECTION 2 – OUR PRODUCTS
The milbrets.com store offers original artwork created by Lauris Mīlbrets, including original paintings and selected art products such as Canvas Prints.
Original Artwork
Each original painting is an individual artwork. Minor variations in texture, color, surface appearance and other characteristics are inherent to original artwork and should not be considered defects.
Product photographs are intended to represent the artwork as accurately as reasonably possible.
Colors may appear somewhat different depending on your monitor, screen, browser, device settings and lighting conditions.
Canvas Prints
Canvas Prints are produced on demand based on the artwork offered through milbrets.com.
Canvas Prints may be produced and fulfilled by third-party production partners in different countries or regions depending on the customer's delivery destination and available production facilities.
Because Canvas Prints are manufactured to order, the final physical product may have minor variations in color, texture or finishing compared with what is displayed on your screen.
Such reasonable variations do not necessarily constitute a defect.
However, nothing in this section limits your statutory rights regarding products that are defective, damaged, incorrect or not in conformity with the contract.
SECTION 3 – ORDERS AND ACCEPTANCE
When you place an order through milbrets.com, you are making an offer to purchase the selected product.
After submitting an order, you will normally receive an order confirmation by email.
An order becomes accepted when we confirm acceptance of the order or otherwise begin fulfilling the order.
We reserve the right to refuse or cancel an order where there is a legitimate reason, including:
- the product being unavailable;
- an obvious pricing or product-description error;
- suspected fraudulent activity;
- an inability to verify payment;
- an incorrect or incomplete delivery address; or
- other circumstances where fulfillment of the order is not reasonably possible.
If we cancel an order after payment has been received, we will refund the amount paid for the canceled order.
Please review your order carefully before completing your purchase.
Cancellation, withdrawal, return and refund rights are governed by applicable law and our Return and Refund Policy.
SECTION 4 – PRICES AND BILLING
All prices displayed on milbrets.com are shown in the currency indicated on the website.
Prices, discounts and promotions may change from time to time. The price applicable to your order is the price displayed at the time the order is placed, unless an obvious pricing error has occurred.
Where applicable, taxes such as VAT may be included in or added to the displayed price depending on the customer's location and applicable tax rules.
Shipping costs and any additional charges applicable to an order will be displayed before the purchase is completed where required by applicable law.
For international orders, customs duties, import taxes or other charges may apply depending on the destination country.
Where such charges are the responsibility of the customer, they are not included in the product price unless expressly stated otherwise.
You agree to provide accurate and complete billing and payment information.
Payment processing is handled through Shopify and/or the payment providers available at checkout.
SECTION 5 – SHIPPING AND DELIVERY
We ship orders to the destinations made available at checkout.
Delivery times shown on the website are estimates and may vary depending on the destination, production time, carrier, customs processing and other circumstances.
For Canvas Prints, production may take place at a fulfillment facility located in or near the customer's destination country.
This may allow certain orders, including orders delivered to the United States, to be produced domestically and may reduce or eliminate customs or import charges that would otherwise apply to an international shipment.
However, the exact production location and any applicable taxes, duties or import charges may vary depending on the order and destination.
We are not responsible for delays caused by circumstances beyond our reasonable control, including carrier delays, customs procedures, severe weather, strikes, natural disasters or other extraordinary events.
However, nothing in these Terms limits your mandatory statutory rights concerning delivery or non-delivery of an order.
You are responsible for providing a complete and accurate delivery address.
Where an order cannot be delivered because the customer provided an incorrect or incomplete address, any available remedies will be handled in accordance with applicable law and our Return and Refund Policy.
SECTION 6 – INTELLECTUAL PROPERTY
All artwork, paintings, photographs, images, designs, text, graphics, logos, product descriptions and other content available through milbrets.com are owned by or licensed to Lauris Mīlbrets, unless otherwise stated.
Purchasing an original painting or Canvas Print does not transfer copyright or other intellectual property rights in the underlying artwork to the purchaser.
Unless expressly agreed otherwise in writing, the purchase of a product grants you ownership of the physical product only.
You may not reproduce, copy, scan, digitally reproduce, modify, distribute, publish, sell or commercially exploit the artwork or other protected content without prior written permission from Lauris Mīlbrets.
All rights not expressly granted are reserved.
SECTION 7 – OPTIONAL THIRD-PARTY TOOLS
The Services may use or provide access to certain tools, applications or features provided by third parties.
Such third-party services may operate under their own terms and privacy policies.
We are not responsible for third-party services to the extent that matters relating to those services are outside our reasonable control.
Your use of such services may therefore also be subject to the applicable third-party terms.

These links are provided for convenience and do not necessarily constitute an endorsement of the third party or its services.

SECTION 9 – RELATIONSHIP WITH SHOPIFY
Lauris Mīlbrets uses Shopify to provide the e-commerce platform that powers milbrets.com.
However, purchases made through milbrets.com are transactions between you and Lauris Mīlbrets.
Shopify provides the technical infrastructure for the store but is not the seller of the products offered through milbrets.com.
Shopify's own services and processing of personal information are subject to Shopify's applicable terms and privacy policies.
SECTION 10 – PRIVACY POLICY
Your use of the Services and our processing of personal information are subject to our Privacy Policy.
Our Privacy Policy explains what personal information we collect, how we use it, how it may be shared with service providers and what rights you may have.
By using the Services, you acknowledge that you have reviewed our Privacy Policy.
